大阪大学の元非常勤講師らが雇い止めの無効などを訴えた裁判。控訴審で逆転勝訴です。
大阪大学の非常勤講師だった4人は、5年以上働き労働者として無期雇用に転換できるのに雇い止めされたのは不当などとして、大学を相手に訴えを起こしていました。1審の大阪地裁判決は「契約締結時に労働者だったとは認められない」などとして訴えを退け、4人は控訴していました。
15日の控訴審判決で大阪高裁は「シラバスに基づく授業を実施するという点などから、大学の指揮監督下にあり、労働者だったことが認められる」などとして、雇止めは無効と判断。阪大に対し、雇い止め後の未払い賃金など総額約1500万円の支払いを命じました。
（原告 浦木貴和さん）「労働者じゃないとずっと言われてきた。そういうことに対する思いが認められた」
阪大は「判決を精査し、上告など対応を検討したい」とコメントしています。
