Why Robin Padilla’s force majeure argument is wrong, according to law prof | DZMM TeleRadyo

Robin Padilla’s argument that the Middle East War and the El Niño phenomenon cannot be used as justification to allow senators to do remote voting. Padilla earlier cited the war, El Niño and even the China-Taiwan conflict as force majeure events that justify teleconferencing. Tiu, however, said these events should not affect how senators do their work. “Ang purpose ng force majur ay bilang excuse na hindi mo magawa ang kailangan mong gawin. In this case, hindi naman ‘yan nakakaapekto sa kanilang trabaho, hindi makaapekto sa kanilang pag-attend ng session for it to matter tulad ng paano siya gamitin sa mga obligasyon na hindi mo magagawa yung obligasyon mo dahil may force majur. In the same case, dahil hindi siya makakaapekto, it's not relevant to their duties,” Tiu said. “Like COVID-19 and the pandemic was a force majeure kasi yan talagang nakapagpigil sa mga tao na magpunta sa kanilang mga opisina because of the health situation.
